Welcome to Beconspec.com, a proprietary service operated by Business Excellency Consultants (BEC). By accessing or using our platform, you agree to the following legally binding Terms and Conditions. If you do not agree, discontinue use immediately.

1. Definitions

a. “Platform” refers to the website and services offered through Beconspec.com.
b. “User” or “You” refers to any person or entity using the platform.
c. “Services” include specification creation (free), and paid access to BOQs/specs.
d. “BEC”, “We”, “Us”, “Our” refers to Business Excellency Consultants.

2. Acceptance of Terms

By using this site, you warrant that you are at least 18 years old and legally competent. Use of the platform signifies full and unconditional acceptance of these Terms.

3. Account & Access

  • Users must register to use the Services. You are solely responsible for protecting your credentials and all activities conducted under your account.
  • BEC may terminate or restrict your account in case of policy violations, security threats, or misuse.

4. Services Offered

  • Free Tier: Create and save architectural hardware specifications.
  • Paid Tier: Download BOQs/specifications on a subscription basis.
  • BEC reserves the right to modify, suspend, or discontinue Services at any time.

5. Intellectual Property

  • All templates, generated specifications, visual content, and proprietary code are owned by BEC or its licensors.
  • Users may not replicate, distribute, resell, modify, or reverse-engineer any part of the platform or its outputs without explicit permission.

6. No Warranties or Representations

BEC makes no representations or warranties of any kind, express or implied, regarding:

  • Accuracy, completeness, or reliability of the specifications or BOQs
  • Fitness of the output for any specific architectural, regulatory, or contractual use
  • Uninterrupted access, error-free operation, or freedom from harmful components

Use of the Services and generated data is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law:

  • BEC shall not be liable for any direct, indirect, incidental, punitive, or consequential damages, including but not limited to data loss, loss of profits, reputational damage, or delays in project execution.
  • In no event shall BEC’s total liability exceed the subscription amount paid by you in the 3 months preceding the claim.

8. Indemnity

You agree to fully indemnify, defend, and hold harmless BEC, its directors, employees, affiliates, licensors, and agents from and against all third-party claims, demands, liabilities, damages, losses, costs, and expenses (including legal fees) arising from:

  • Your use or misuse of the Platform
  • Your violation of these Terms or applicable law
  • Any content or data input by you
  • Any claim that the use of the specifications or downloads infringes on intellectual property or contractual obligations

This clause survives termination or suspension of your access or usage.

9. User Obligations

You agree not to:

  • Use the platform for illegal or fraudulent activities
  • Upload or generate content that infringes third-party rights
  • Interfere with platform integrity (e.g., DDoS, brute force)
  • Reverse engineer, copy, or sell outputs
  • Misrepresent the use of BEC-generated documents in your own offerings

BEC reserves the right to monitor, audit, and suspend any account suspected of such behavior.

10. Subscription & Payment Terms

  • Paid plans are auto-renewed unless canceled before the renewal date.
  • You agree to pay all applicable fees and taxes as stated at checkout.
  • Cancellation and refund terms are governed by our Refund & Cancellation Policy.

11. Third-Party Content & External Links

Embedded third-party videos, documents, or references are governed by their respective terms. BEC does not guarantee accuracy or availability of external content and disclaims any liability arising from its use.

12. Data Privacy

Use of personal data is governed by our Privacy Policy, which complies with the DPDP Act, 2023.

13. Force Majeure

BEC shall not be liable for failure to perform its obligations due to events beyond its reasonable control, including acts of God, cyberattacks, internet outages, legal restrictions, or pandemics.

14. Termination

BEC may terminate or suspend your access:

  • For violation of these Terms
  • If required by law or authority
  • Upon discovery of misuse, fraud, or IP infringement

Termination will not relieve you of accrued obligations or payments due.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

16. Dispute Resolution

In the event of disputes, users must first notify BEC at [email protected] for resolution. If unresolved within 30 days, either party may seek remedies under applicable Indian laws.

17. Changes to Terms

BEC reserves the right to revise these Terms. Continued use after changes constitutes acceptance. Material changes will be communicated via email or website notice.
